1. Acceptance of these terms

By accessing this website or using services offered by Cardinal Care Advisors, including HOMEWARD by Cardinal, you agree to these Terms & Conditions and our Privacy Policy. If you do not agree, do not use the website or services.

2. Nature of HOMEWARD services

HOMEWARD provides planning, navigation and family coordination services. HOMEWARD is not an emergency response service and does not diagnose medical conditions or replace licensed medical, nursing, home-care, legal, financial or other regulated professional services.

3. Emergencies

Do not use the website, Care Pair, email or text messaging for an emergency. For a life-threatening emergency, call 911. For urgent medical concerns, contact the appropriate licensed healthcare provider.

4. Assessments, plans and memberships

Service descriptions and prices shown on the website are subject to availability and any written service agreement. Membership agreements may define included staff time, response expectations, billing, renewal, cancellation and services billed separately. A HOMEWARD Plan is a planning and coordination tool, not a medical diagnosis, guarantee of safety or guarantee that remaining at home will always be appropriate.

5. Third-party providers

HOMEWARD may help families identify or coordinate with independent providers, contractors and community resources. Unless expressly stated otherwise in writing, those parties are independent and responsible for their own credentials, pricing, services, availability and work.

6. Website use

You agree not to misuse the website, attempt unauthorized access, interfere with operation, submit unlawful content or use the website in a way that violates another person's rights. Website content is provided for general information and may be changed without notice.

7. Payments and refunds

Payment terms, refund eligibility and cancellation rules for paid assessments or memberships are governed by the offer presented at purchase and any applicable written agreement. Third-party services are billed separately unless expressly included.

8. Messaging Program Terms and Conditions

1. The messaging program may consist of general customer-care messaging to answer questions and provide support to customers and/or marketing messaging that may include discounts, contests, special deals or texts promoting products or services, depending on the program or programs you opt in to. We send messages only after you explicitly sign up through our opt-in process. Messages will be sent from (716) 300-2769.
2. You may cancel the SMS service at any time by replying STOP to the number from which you received messages. After you send STOP, we will send one confirmation message and you will no longer receive SMS messages from us. To join again, complete the applicable opt-in process again.

4. Mobile carriers are not liable for delayed or undelivered messages.
5. Message and data rates may apply to messages we send and messages you send to us. Message frequency varies based on communication needs. Contact your wireless provider with questions about your text or data plan.

By opting in, you confirm that you are authorized to use the telephone number provided and consent to receive messages for the selected program. Consent to receive marketing messages is not a condition of purchase.

9. Intellectual property

The website, branding, text, graphics and original materials are owned by Cardinal or used with permission and may not be copied or exploited without authorization, except as allowed by law.

10. Disclaimer and limitation

To the extent permitted by law, the website and general information are provided “as is” without warranties of uninterrupted availability or fitness for a particular purpose. Cardinal is not responsible for decisions made solely from website content or for the acts or omissions of independent third parties.

11. Governing law

These terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.
